1. These are the terms and preconditions under which we offer you access to our websites (Sites). Please read them carefully.  Additional terms and preconditions may apply to Public Record Search Orders, including State or Nationwide Asset, (Bank/Investment/Safety Deposit  Box/Hard Assets), and we reserve the right to revise these terms and preconditions, and any other agreements, policies or terms incorporated by reference herein, and any other agreements, policies or terms incorporated by reference, at any time without notice.  By using this site subsequent to the revision, you agree to be bound by such changes.  Your use of our site will be considered to be your acceptance of these terms and preconditions and any of the additional terms and preconditions.  If you find the terms and preconditions to be unacceptable, you must immediately terminate you use of our site. 
   
   If you place an order with our company for a public records search, of any type including but not limited to all asset and bank account locator searches, you agree to all the terms and conditions as stated in this Disclaimer in paragraphs 1-8.  You also agree to be bound by these conditions as detailed in our company's Disclaimer, in paragraphs 1-8, and that this Disclaimer and the verbiage contained therein, may be used against you as the "best evidence" that you agreed to these preconditions before ordering, in any court proceeding involving any dispute with our company.

YOUR ORDER FOR SERVICES IS BEING ACCEPTED SUBJECT TO THE IMPORTANT TERMS AND PRECONDITIONS ON THIS PAGE AND THE FOLLOWING PAGES.  READ TERMS AND PRECONDITIONS CAREFULLY, AS YOU AGREE TO BE BOUND BY THEM WHEN PLACING AN ORDER FOR PUBLIC RECORD SEARCHES WITH US RECORD SEARCH AND INFORMATION SERVICES, INC.
   
   IMPORTANT NOTICE TO CUSTOMER PLACING ORDERS FOR PUBLIC RECORD SEARCHES THROUGH US RECORD SEARCH AND INFORMATION SEARCHES, INC.
   
   THIS DOCUMENT IS A LEGALLY BINDING CONTRACT BETWEEN YOU AND US. THIS CONTRACT CONTAINS ALL THE TERMS OF OUR AGREEMENT AND SUPERCEDES ALL OTHER ORAL OR WRITTEN AGREEMENTS, COMMUNICATIONS OR REPRESENTATIONS.  THE WORD "YOU"REFERS TO ALL PERSONS ORDERING PUBLIC RECORD SEARCHES THROUGH ASSET TRACKERS WEBSITE.
   
   INCLUDING YOUR HEIRS, SUCCESSORS IN INTEREST AND PERSONAL REPRESENTATIVES.  THE WORDS "WE" AND "US" REFER TO THE FULL CORPORATE NAME ASSET TRACKERS AND/OR THE OWNER, EMPLOYEES, INDEPENDENT CONTRACTOR'S', CORPORATE COUNSEL, AND/OR  ANY OTHER AGENTS DOING WORK FOR THE COMPANY/OWNER ALL OF WHICH ARE DESCRIBED IN CLAUSE THIS CLAUSE
   
   NOTICE:  YOUR ATTENTION IS EXPECIALLY DIRECTED TO PARAGRAPHAS 3, 4, 5, 6, 7 AND 8 BELOW, WHICH CONTAIN IMPORTANT LIMITATIONS ON YOU RIGHT TO ASSERT CLAIMS AGAINST US AND CERTAIN THIRD PARTIES.ALL DISPUTES AND MATTERS WHATSOEVER ARISING UNDER, IN CONNECTION WITH OR INCIDENT TO THIS CONTRACT, ASSET TRACKERS SHALL BE LITIGATED, IF AT ALL, IN AND BEFORE THE CIRCUIT COURT, 17th JUDICIAL CIRCUIT IN AND FOR BROWARD COUNTY FLORIDA, TO THE EXCLUSION OF ANY OTHER COURT, IN ANY OTHER STATE, REGARDLESS OF WHETHER ONE OF THESE COURTS MAY CLAIM CONCURRENT JURISDICTION OVER THE MATTER GIVING RISE TO THIS DISPUTE.

3. IMPORTANT TERMS AND CONDITIONS OF CONTRACT - READ CAREFULLY BEFORE ACCEPTING.
   

   1. GENERAL PROVISIONS- Important Definitions/No Refunds of any kind once a Public Record Search is ordered, which will be after your form of payment has cleared our bank.  No Guarantees as to any time period when search results will be returned to you.  All time given by our employees are approximation only and are not promises.  The approximations are based on average times when this type of search can be returned.  These approximations are based on the average time it take for non-complex searches to be returned and no one knows if the search ordered by the customer is simple or complex until the search is actually started after the form of payment provided by the customer clears and cannot be cancelled. These time approximations are not promises or warranties of a drop dead date for the return of any result, especially asset and bank searches which are complex searches and require several procedures.

   2. IF YOU REQUIRE THE RESULTS OF ANY SEARCH BY A CERTAIN DATE, OR REQUIRE A SPECIFIC TYPE OF RESULT BY A SPECIFIC DATE, DO NOT ORDER YOUR SEARCH FROM OUR COMPANY AS WE CANNOT GIVE YOU AN EXACT DAT BY WHICH YOUR RESULTS WILL BE DELIVERED AND OUR COMPANY CANNOT GUARANTEE THAT YOU WILL BE SATISFIED WITH THE RESULTS FROM A PUBLIC RECORDS SEARCH INCLUDING RECEIVING A LETTER FROM OUR COMPANY THAT NO RECORDS HAVE BEEN FOUND BASED UPON THE INFORMATION SUPPLIED BY YOU, THE CUSTOMER.

   3. NO REAL PUBLIC RECORDS SEARCH COMPANY CAN GIVE YOU A TIME GUARANTY OR GUARANTEE THAT YOU WILL BE SATISFIED WITH THE RESULTS YOU RECEIVE. THOUSAND OF OUR CUSTOMERS ARE SATISFIED WITH THE RESULTS THEY RECEIVE WHEN THEY RECEIVE THEM.  BUT, THERE ARE ALWAYS A SMALL NUMBER OF PEOPLE WHO ORDER SEARCHES AND DO NOT RECEIVE RESULTS WITHIN CERTAIN TIME PERIODS WHICH THE CUSTOMER REQUIRES OR THEY RECEIVE A LETTER WHERE NO RECORDS WERE FOUND.  IN THESE CASES, WE TRY TO ACCOMMODATE THE CUSTOMER BY PERFORMING ADDITIONAL SEARCHES FOR THEM AT NO ADDITIONAL CHARGE OR RESUBMITTING THEIR DOCUMENTS FOR ANOTHER ATTEMPT TO FIND RECORDS, HOWEVER, BY PLACING AN ORDER WITH US, YOU AGREE THAT YOU WILL RECEIVE NO CASH REFUND EVEN IF THE RESULTS FROM THE SEARCH ORDERED THROUGH US ARE NOT WHAT YOU WERE HOPING FOR AND/OR NOT DELIVERED WITHIN THE TIME PERIOD THAT YOU WERE HOPING FOR.

4. NO GUARANTEE AS TO WHEN SEARCH RESULTS WILL BE RETURNED TO YOU.  ALL TURN-AROUND TIMES FOR WHEN SEARCH RESULTS MAY BE RETURNED, GIVEN BY OUR EMPLOYEES ARE APPROXIMATIONS NOT PROMISES OR WARRANTIES.  IF THE SEARCH COMES BACK LATER THAN WHAT YOU HAD HOPED FOR OR OUTSIDE OF THE APPROXIMATION GIVEN TO YOU BY OUR EMPLOYEES, YOU WILL NOT BE ENTITLED TO A CASH REFUND OF ANY KIND AND YOU AGREE TO THIS AS A PRECONDITION FOR PLACING AN ORDER WITH OUR COMPANY AND FOR OUR COMPANY ACCEPTING YOUR ORDER.
   
   IF YOUR FORM OF PAYMENT DOES NOT CLEAR OUR BANK FOR ANY REASON WATSOEVER, YOUR SEARCH IF ORDERED WILL BE STOPPED IMMEDIATELY AND IF RESULTS HAVE BEEN RECEIVED, WE WILL NOT GIVE THEM TO YOU UNTIL YOU SEND US A MONEY ORDER OR CERTIFIED CHEDK FOR THE AGREED UPON AMOUNT PLUS A $25.00 BOUNCED CHECK, RETURN CHARGE/DEBIT FEE.
   
    WE GUARANTEE THAT YOUR PUBLIC RECORD SEARCH WILL BE PERFORMED BUT WE DO NOT GUARANTEE THAT YOU WILL BE SATISFIED  WITH THE RESULTS THAT YOU RECEIVE FROM A PUBLIC RECORDS SEARCH, IF ANY.  THE SITE WHERE THIS CONTRACT FOR A PUBLIC RECORD SEARCH IS BEING ORDERED IN CITY OF POMPANO BEACH, STATE OF FLORIDA.
   
   
5. NO REFUNDS/NO TIME GUARANTEES/NO GUARANTEES OF SATISFACTION WITH RESULTS.  THIS IS AN EXPRESSED PRECONDITION FOR ASSET TRACKERS TO ACCEPT YOUR ORDER TO CONDUCT A PUBLIC RECORD SEARCH.
   
   We also, do not guarantee that you will be satisfied with the results that are sent to you for a Public Record Search conducted by our company.  We guarantee we will perform your search, however, we do not guarantee the integrity or veracity of any information provided by any Public Record Repository, including but limited to Financial Institutions, Banks, County, State or Federal “Clerks of Court Offices”, to which we submit Public Record Search Requests.  We guarantee that we will perform your Public Record search, however, we do not guarantee what type of results you will receive.
   
   FINALLY, WE ARE NOT ACTING AS YOUR ATTORNEY OR GIVING OUR ANY TYPE OF LEGAL ADVICE.  WE CAN ONLY PERFORM SEARCHES FOR RECORDS AVAILABLE TO THE PUBIC.  AN ATTORNEY, WHOM YOU HIRE, MAY BE ABLE TO GET DIFFERENT RESULTS BY ACTING AS YOUR ATTORNEY AND USING DIFFERENT STATE LAWS TO GET NON-PUBLIC AND/OR PRIVATE RECORDS THROUGH PRIVATE SUBPOENA’S.  We do not act as your attorney or use private attorney created subpoenas duces tecum for production of documents from 3rd parties.  If you want this type of complex service, hire an attorney or do it yourself.
   
   
6. GOVERNING LAW IN CASE OF DISPUTE
   This site is controlled and operated by ASSET TRACKERS from its offices within the State of Florida, United States of America.  These terms shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any statutory conflicts of law provisions which may exist in the State from which you call us, to place an order in Florida, establishing some sort of long arm jurisdiction.  You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the State Court, 17th Judicial Circuit, locating in Broward County Florida and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.   You agree that the venue for all disputes is limited to Broward County in the State of Florida AND you specifically waive your right to litigate any legal dispute against our company, in any court in your home State or any other State, regardless of the long arm statutes that may exist in your State to create jurisdiction, except in the state court in Broward County in the State of Florida.
   
   
7. SEVERABILITY
   These terms and conditions incorporate by reference any notices contained on this website and constitute the entire agreement with respect to your access to and use of this website.  Any provision of these terms and conditions which is determined by a court of competent jurisdiction to be unenforceable in any jurisdiction shall be severable from these terms and conditions in that jurisdiction without in any way invalidating the remaining provisions of these terms and conditions.  The unenforceability of any provision in a given jurisdiction shall not make that provision unenforceable in any other jurisdiction.
   
   
8. MISCELLANEOUS TERMS
   Your being permitted to use this site will not be construed as creating any joint venture, partnership, employment or agency relationship between you and ASSET TRACKERS   In the event of litigation involving the use of this site, the prevailing party will be entitled to recover its reasonable attorneys’ fees and costs.
   
   This is the entire agreement between you and us relating to the subject matter herein and cannot be modified except in writing, signed by both you and a corporate officer of ASSET TRACKERS.  These terms and preconditions are effective until terminated by ASSET TRACKERS, for any reason, with or without notice.  Upon termination, you must destroy all materials obtained from this site and all copies thereof, whether made under the terms of these terms and conditions or otherwise.
